This website is operated by Fortalyn (“Fortalyn”, “we”, “us” or “our”), the trade name under which this store does business. Throughout the site, “we”, “us” and “our” refer to Fortalyn. We offer this website, including all information, tools and services available from it, to you on the condition that you accept all terms, conditions, policies and notices stated here.

By visiting our site and/or purchasing from us, you engage in our “Service” and agree to be bound by these Terms of Service and Terms of Sale (together, the “Terms”), including the additional policies referenced here and available by hyperlink (Privacy Policy, Refund Policy, Shipping Policy). These Terms apply to all users of the site, including browsers, customers and contributors of content. If you do not agree, you may not access the website or use any services. Any new features or tools added to the store are also subject to these Terms. We may update these Terms at any time by posting changes on this page; your continued use of the website after changes are posted means you accept them.

Our store is hosted on Shopify Inc., which provides the online e-commerce platform that allows us to sell our products and services to you.

Section 1 — Online store terms

By agreeing to these Terms, you represent that you are at least 18 years old and the age of majority in your state or province of residence. You may not use our products for any illegal or unauthorized purpose, nor violate any laws in your jurisdiction (including copyright laws). We reserve the right to refuse service to anyone for any reason at any time. Your content (not including credit card information) may be transferred unencrypted and involve transmissions over various networks and changes to conform to technical requirements; credit card information is always encrypted during transfer. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, its use, or access to it without our express written permission. We are not responsible if information on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon as the sole basis for decisions without consulting more accurate, complete or timely sources. Any reliance on the material on this site is at your own risk. The site may contain historical information that is not necessarily current. We may modify the contents of this site at any time but have no obligation to update any information.

Section 4 — Modifications to the Service and prices

Prices for our products are subject to change without notice. Promotions, bundles, discounts and countdown timers reflect our current promotional schedule and may be modified, extended, renewed or discontinued at any time. We may modify or discontinue the Service (or any part of it) without notice. We are not liable to you or any third party for any modification, price change, suspension or discontinuance of the Service.

Certain products may be available exclusively online through the website and may have limited quantities. They are subject to return or exchange only according to our Refund Policy. We make every effort to display product colors and images accurately but cannot guarantee that your monitor's display will be accurate. If we change or cancel an order, we will try to notify you by contacting the email and/or billing address or phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that appear to be placed by dealers, resellers or distributors. You agree to provide current, complete and accurate purchase and account information for all purchases and to promptly update it as needed.

Section 7 — Optional tools and add-ons

We may give you access to third-party tools over which we neither monitor nor have any control. You acknowledge that we provide such tools “as is” and “as available” without warranties, representations or conditions of any kind and without endorsement. Optional paid add-ons offered in the cart, such as Shipping Protection & Discreet Packaging, are shown with their price and can be removed before checkout; their terms are described in our Shipping Policy.

Certain content, products and services available via our Service may include materials from third parties. Third-party links may direct you to websites that are not affiliated with us. Section 11 — Errors, inaccuracies and omissions

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information is inaccurate at any time without prior notice, including after you have submitted your order.

We may terminate your use of the Service for violating any prohibited use.

All content on this website, including the Fortalyn name, logo, text, graphics, photographs, illustrations, designs and page layouts, is owned by Fortalyn or its licensors and protected by intellectual property laws. You may not copy, modify, distribute or create derivative works from any of it without our prior written consent.

Section 14 — Indemnification

You agree to indemnify, defend and hold harmless Fortalyn and its owners, affiliates, partners, officers, agents, contractors, licensors, service providers, suppliers and employees from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms or the documents they incorporate by reference, or your violation of any law or the rights of a third party.

Section 15 — Severability

If any provision of these Terms is found to be unlawful, void or unenforceable, that provision shall still be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed without affecting the validity of any other provisions.

Section 16 — Termination

The obligations and liabilities incurred before the termination date survive termination. These Terms are effective unless and until terminated by you or us. You may terminate them at any time by ceasing to use our site. If we suspect that you have failed to comply with any term, we may terminate this agreement at any time without notice and deny you access to our Services.

Section 17 — Entire agreement

Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision. These Terms and any policies or operating rules posted by us on this site constitute the entire agreement between you and us and supersede any prior agreements, communications and proposals. Any ambiguities in interpretation shall not be construed against the drafting party.

Section 18 — Governing law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-law provisions. For purchases, returns, billing and disputes, Part B (Terms of Sale) controls.

Part B — Terms of Sale

1. Important information

THIS DOCUMENT CONTAINS IMPORTANT INFORMATION ABOUT YOUR RIGHTS AND OBLIGATIONS, INCLUDING LIMITATIONS AND EXCLUSIONS. IT REQUIRES DISPUTES TO BE RESOLVED THROUGH INDIVIDUAL ARBITRATION RATHER THAN JURY TRIALS OR CLASS ACTIONS, UNLESS YOU OPT OUT (SEE SECTION 15). BY PLACING AN ORDER YOU ACCEPT THESE TERMS. YOU MAY NOT ORDER FROM THIS WEBSITE IF YOU DO NOT AGREE TO THEM, ARE UNDER 18 OR NOT OF LEGAL AGE TO FORM A BINDING CONTRACT, OR ARE PROHIBITED FROM USING THIS WEBSITE BY APPLICABLE LAW.

These Terms of Sale apply to the purchase of products through fortalyn.shop (the “Site”). We may change them at any time without prior notice; the version posted on the Site at the time of your order applies to that order.

2. Order acceptance and cancellation

Your order is an offer to buy the products in your cart. All orders must be accepted by us; we are not obligated to sell to you. We accept your order when we ship the products. We may refuse or cancel any order at our discretion, including for suspected fraud, pricing or listing errors, stock issues or resale activity. If we cancel after you were charged, we will refund the amount charged.

3. No medical advice; dietary supplement disclaimer

The information on this Site is for general informational purposes only. It is not medical advice and is not a substitute for advice from a qualified healthcare provider. The statements made on this Site have not been evaluated by the Food and Drug Administration. Fortalyn products are dietary supplements and are not intended to diagnose, treat, cure or prevent any disease.

Consult your physician before use, especially if you are pregnant or nursing, under 18, have a bleeding disorder, have a medical condition or have surgery scheduled, or take any medication, including anticoagulant or antiplatelet medication (such as warfarin, apixaban, rivaroxaban, clopidogrel or daily aspirin), blood-pressure medication, or erectile-dysfunction medication. Nattokinase may affect blood clotting. Discontinue use and consult a doctor if you experience any adverse reaction. Do not exceed the recommended serving. Keep out of reach of children. Do not use if the safety seal is broken or missing.

Educational content on the Site (including articles about circulation, arteries or men's health, and references to studies) is provided for general background and does not imply that our products have been evaluated for any disease or condition. Fortalyn does not guarantee that you will achieve any particular health, wellness or performance goal. Results vary based on factors unique to each person, such as age, health, lifestyle and genetics.

4. Testimonials and reviews

Testimonials and reviews on the Site reflect the individual experiences of customers and are not necessarily typical. They are not a guarantee or prediction of the results you will experience. Some reviewers may have received a product or discount. We may edit testimonials for length and clarity.

5. Prices and payment terms

All prices are in U.S. dollars and subject to change without notice. The price charged is the price in effect when your order is placed, as shown in your order confirmation email. Prices do not include taxes, shipping or optional add-ons unless stated; these are shown at checkout. We accept the payment methods displayed at checkout. You represent that you are authorized to use the payment method you provide and authorize us to charge it for the total amount of your order. If payment cannot be processed, we may cancel your order.

5A. Subscriptions and automatic renewals

IF YOU PURCHASE A SUBSCRIPTION, YOUR SUBSCRIPTION WILL AUTOMATICALLY RENEW AND YOUR PAYMENT METHOD WILL BE CHARGED AT EACH BILLING PERIOD (EVERY 30 DAYS UNLESS YOU CHOOSE ANOTHER FREQUENCY) UNTIL YOU CANCEL. TO AVOID THE NEXT CHARGE, CANCEL AT LEAST 24 HOURS BEFORE YOUR NEXT BILLING DATE.

You can cancel online at any time through the “Manage subscription” link or your account, or by emailing info@fortalyn.shop. Cancellation requests received after a renewal has been charged apply to the following period. We will notify you in advance of any price change. Full details are in our Subscription Policy, which is part of these Terms. We may refuse or cancel any subscription at our discretion.

6. Shipment, delivery, title and risk of loss

We arrange shipment of products to the address you provide. You pay the shipping and handling charges shown at checkout. Title and risk of loss pass to you when we transfer the products to the carrier. Delivery dates are estimates only and are not guaranteed; we are not liable for carrier delays. Optional Shipping Protection covers loss, theft or damage in transit as described in our Shipping Policy.

7. Returns and refunds

Unopened, unused products in their original sealed packaging may be returned within 90 days of delivery under our 90-Day Money-Back Guarantee. Opened or used products are not eligible. Shipping, Shipping Protection and return shipping costs are non-refundable, except for damaged or incorrect items. Please read our Refund Policy for full details; it is part of these Terms.

8. Electronic communications

You consent to receive electronic communications from us by email, text message (if you opt in) or notices posted on the Site, and agree that these satisfy any legal requirement that communications be in writing. Transactional messages (such as order confirmations and shipping updates) are sent regardless of your marketing preferences. You can opt out of marketing emails at any time using the unsubscribe link or by writing to info@fortalyn.shop.

9. Disclaimer of warranties

EXCEPT WHERE PROHIBITED BY LAW, THE SITE AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT PERMITTED BY LAW, FORTALYN DISCLAIMS ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE OR FREE OF HARMFUL COMPONENTS, OR THAT ANY PRODUCT WILL MEET YOUR EXPECTATIONS OR PRODUCE ANY PARTICULAR RESULT.

10. Limitation of liability

EXCEPT WHERE PROHIBITED BY LAW, IN NO EVENT WILL FORTALYN OR ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA OR GOODWILL, ARISING FROM YOUR USE OF THE SITE OR ANY PRODUCT, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you.

11. Goods not for resale or export

You represent that you are buying products for your own personal or household use only, not for resale or export. We may cancel orders that we believe are placed for resale.

12. Privacy

Our Privacy Policy governs how we collect and use personal information in connection with your purchase.

13. Force majeure

We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including natural disasters, fire, flood, epidemic or pandemic, war, terrorism, civil unrest, government action, strikes or labor disputes, carrier delays, supply shortages, or failures of power, internet or telecommunications.

14. Governing law and jurisdiction

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law rules, and by the Federal Arbitration Act for Section 15. Subject to Section 15, any claim that is not arbitrated shall be brought exclusively in the state or federal courts located in Wyoming, and you consent to their jurisdiction.

15. Dispute resolution and binding arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY HEAR YOUR CLAIMS.

(a) Informal resolution first. Before starting any claim, you agree to email info@fortalyn.shop with a description of the issue and the relief you seek, and to give us 30 days to try to resolve it informally. Most issues are solved this way.

(b) Binding arbitration. If we cannot resolve the dispute informally, any dispute or claim arising out of or relating to these Terms, our products, our Site, our marketing or our Privacy Policy shall be resolved by binding, individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, before a single arbitrator. The Federal Arbitration Act governs this provision. The arbitrator may award any individual relief that a court could award.

(c) Class action waiver. You and Fortalyn agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective or representative proceeding. The arbitrator may not consolidate claims of more than one person.

(d) Exceptions. Either party may bring an individual claim in small claims court if it qualifies, and either party may seek injunctive relief in court to protect intellectual property rights.

(e) 30-day right to opt out. You may opt out of this arbitration agreement by emailing info@fortalyn.shop within 30 days of your first purchase, with your name, order number and a clear statement that you opt out of arbitration. Opting out does not affect any other part of these Terms.

(f) Severability. If the class action waiver is found unenforceable for any claim, that claim shall proceed in court, not in arbitration, and the rest of this Section remains in effect.

16. Assignment

You may not assign any of your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.

17. No waivers

Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.

18. No third-party beneficiaries

These Terms do not give any rights or remedies to any person other than you and Fortalyn.

19. Notices

We may give you notice by email to the address associated with your order or by posting on the Site. You may give us notice by email to info@fortalyn.shop or by mail to Fortalyn, 30 N Gould St, Sheridan, WY 82801, United States.

20. Severability

If any provision of these Terms of Sale is invalid or unenforceable, it shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions remain in full force and effect.

21. SMS / text message program

If you opt in to Fortalyn text messages, you agree to receive recurring automated marketing and informational messages (such as offers, cart reminders and order updates) at the mobile number you provide. Consent is not a condition of any purchase. Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe at any time and HELP for help, or email info@fortalyn.shop. Carriers are not liable for delayed or undelivered messages. You confirm you are the account holder or authorized user of the mobile number and are at least 18. Mobile information is never sold or shared with third parties for their own marketing purposes; see our Privacy Policy.

22. Entire agreement

These Terms of Service and Terms of Sale, together with our Privacy Policy, Refund Policy and Shipping Policy, constitute the entire agreement between you and Fortalyn regarding your use of the Site and your purchases.
